Mental Hygiene and Guardianship

Our attorneys have represented individuals faced with the care of family members or loved ones who are unable to make decisions regarding their personal care or finances. Our attorneys have experience in durable powers of attorney, and guardianship and other proceedings under Article 81 of the NYS Mental Hygiene Law.

Guardianship of a person enables the appointed guardian to make decisions regarding the care and support of an incapacitated individual. Guardianship of the property allows the appointed guardian to take responsibility for an incapacitated individual’s personal and real property. The same person can be both guardian of the person and guardian of property.

Our attorneys also have experience representing persons who oppose the appointment of a guardian. Our attorneys have successfully represented individuals in all aspects of guardianship matters.
