Amaker v. Clinton County

Plaintiff arrested and charged with felony contraband after being found in possession of handcuff key while attempting to visit an inmate at a state prison.  Subsequent prosecution by Clinton County District Attorney’s office resulted in acquittal and plaintiff commenced federal action against County of Clinton, its District Attorney and an Assistant District Attorney as well as other state defendants.  District Court granted Motion to Dismiss filed on behalf of County defendants prior to discovery and the 2nd Circuit Court of Appeals affirmed.
